Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge stated in her ruling.
The case originates in a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was detained in federal detention.
In her decision, the judge noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
